1) Introduction
These General Conditions of Sale apply to all services and products offered by “Garage Decar di Kevin Decarli” (hereinafter “Garage Decar”) as well as to all users of the website www.garagedecar.ch/shop/.
Any natural or legal person who has commercial relations with Garage Decar will be considered a customer.
2) Purpose of the application
Garage Decar provides all deliveries of products and services exclusively on the basis of the following General Conditions of Sale, in the version valid at the time of the order. Any order placed by the customer on www.garagedecar.ch/shop/ implies total understanding and full acceptance of our General Conditions of Sale, which replace and cancel the customer’s general conditions of purchase. No particular condition can prevail against the General Conditions of Sale.

You can register on the website www.garagedecar.ch/shop/ at the top of the website, by clicking on the “My Account” button and then clicking on the “Register” button.
5) Payment methods
The payment methods accepted on www.garagedecar.ch/shop/ are as follows:

- Twint
- Wire transfer
6) Orders of items
Items that are not immediately available in stock or in a third-party warehouse are designated as made-to-order items. These can be ordered at the express request of the customer.
With regard to products ordered with special specifications for the buyer, the cancellation of the order is only possible with the agreement of the supplier, especially if the production of the purchased products has already started. Any costs relating to the cancellation or return of the ordered goods are charged to the customer.
The delivery times indicated on the website are indicative and published on the basis of the information in our possession. No guarantee is given on delivery times, as they could be dependent on delays beyond our control and any compensation of the order to the customer is excluded. A possible delay does not justify a request for cancellation, compensation or refund of the order to the customer. If the items are undeliverable or for any other reason no longer available, Garage Decar reserves the right to cancel the order.
7) Offer
The products, services and prices published on www.garagedecar.ch/shop/ represent the offer. The offer is always subject to the condition of an impossibility of delivery or an incorrect indication of the price by Garage Decar or its suppliers. The photos on the website are not contractually binding; therefore, Garage Decar assumes no responsibility for any differences from the representative images of the item.
8) Cancellation of orders and returns
8.1) Returns
The goods are arranged and sold according to specific customer requests, which means that there is no right to cancel or return the ordered goods.
However, the return of the products ordered by the customer can be accepted and granted only upon express written request by the customer with prior written agreement with Garage Decar.
The return request by the customer must be notified to Garage Decar no later than 14 effective days from the date of the order, in writing to: info@garagedecar.ch.
In the case of returned products, they must be in perfect condition in their original packaging and must not show any sign of use or tampering.
The assessment of the conditions of the returned product is the exclusive responsibility of Garage Decar.
8.2) Order cancellation
Each user registered on www.garagedecar.ch/shop/ has the option of modifying or canceling one or more orders no later than 24 hours from the time and date of completion of the order by writing an e-mail to info@garagedecar.ch.
The modification or cancellation of the order is accepted only if made in writing to the e-mail address communicated above.
All orders placed by users registered on www.garagedecar.ch/shop/ are considered definitive after 24 hours from the time and date of the same.
9) Terms and conditions of delivery
The following delivery methods are possible which, if applicable, involve the following shipping costs:
Collection in store (Via Santa Maria 46, 6596 Gordola)
Free
Delivery of lift kits and accessories (tents and awnings excluded)
10.- CHF + 3% of the sale value of the goods
Tents and awnings
40.- CHF + 3% of the sale value of the goods
Delivery is considered to have taken place as soon as the product is shipped or made available to the customer at our office.
The shipped goods travel at the recipient’s risk and the shipment is governed by the transport conditions of the companies in charge of the delivery. Garage Decar is not responsible for the transport risk of the goods.
The customer must always check the conditions of the goods in front of the driver in charge of the transport before collection and use. In the event of a problem with the delivery or in the event of deterioration or loss of the package, the liability of Garage Decar is excluded.
Damage caused by transport must be reported in writing (email or registered mail) within 24 hours of receiving the package.
If the material does not comply with the order, it must not be used or assembled and must be reported within 48 hours of receipt of the goods. Otherwise, the delivered goods are deemed to have been accepted.
10) Compatibility of products
The compatibility of the products must always be verified by the purchaser before assembly.
Any product that has been assembled and is no longer in its original condition or whose packaging has been damaged will not be accepted as a return.
11) Warranty
Only products delivered with a homologation certificate are guaranteed. Items intended for competition or used on tracks or in extreme conditions (even if provided with a homologation certificate) are excluded from any guarantee.
In the event that the items purchased are not installed at our premises, Garage Decar assumes no liability for damages presumably due to an installation not carried out in a workmanlike manner, or to an installation carried out on a vehicle for which the items themselves were not explicitly designed.
Any modification or repair made to the products sold by Garage Decar, even if carried out by specialized personnel, invalidates the manufacturer’s guarantee.
The warranty period is 12 months from the invoice issuance date.
Garage Decar does not directly offer a guarantee on the articles, it is the guarantee of the manufacturer of the product that must be exercised.
The customer must enforce the guarantee by directly contacting the assistance center indicated by the manufacturer.
12) Responsibility
The liability of Garage Decar for direct and indirect damages is, within the limits of the law, completely excluded. For example, but not only: additional costs such as installation, assembly, painting, etc., as well as all management and administration costs are not attributable to Garage Decar.
13) Data protection
Garage Decar undertakes to treat personal information confidentially and not to disclose it to third parties.

The database and all information on the site are proprietary and cannot be copied or used without a license granted by Garage Decar.
14) Jurisdiction
In the case of a dispute, the competent court is exclusively located in Locarno.
